ACCEPTANCE OF TERMS OF SERVICES:

Please read carefully the terms and conditions including privacy and recommendations. By accessing and using the Website “Service” provided by SEAZONA LLC, you agree to be bound by these Terms of Service. IF YOU DO NOT AGREE TO ALL  the terms and conditions CONTAINED IN THESE TERMS OF SERVICE, DO NOT use the services of the website IN ANY MANNER. SEAZONA RESERVES THE RIGHT to terminate, suspend, change the services, or refuse services to any customers.

NOTIFICATION OF CHANGES:

            SEAZONA reserves the right, at its sole discretion, to modify, change, update, remove or add portions of the Terms of Service at any time, with or without notice to you. PLEASE check these Terms of Service periodically for changes. You will be provided the option to terminate your use of the Service if the Terms of Service is modified in a manner substantially impacting your rights in connection with use of the Website.  However, your continued use of the Website after the posting of any changes to the Terms of Service will be deemed to be your agreement to those changes.          

CANCELATION OF SERVICES:

SEAZONA customers can cancel at any time with the only requirement to contact us via email or by speaking to a seazona representative to notify us of the cancellation of  services. If you notify us via email, you will receive a confirmation email from us. If you do not receive a confirmation email, you are responsible for contacting us via phone in order to cancel. There are no cancellation fees; however, there are no refunds for partial months.

Seazona payment is a recurrent payment, a Seazona representative will contact the bank to stop the recurrent payment. If a customer cancels their payment before notifying Seazona of their cancellation a $75 dollar fee will be charged.

YOU ARE SOLELY RESPONSIBLE to export your data from the website before canceling the account. SEAZONA will delete the data if an account has been canceled or terminated within a week if no property arrangement has been made. (SEAZONA reserves the right to suspend, change and discontinue your website at any time without notice.)

Seazona is a software company, we do not provide financial, accounting, legal, or other professional advice or services.

INFORMATION AND PRIVACY

Your election to use the Website indicates your acceptance of the terms of our Privacy Policy.

Sharing information

        I.            Seazona will share information to companies that provide services TO HELP us with our business activities such as our payment processor or updates. These companies are authorized to use your personal information only as necessary to provide these services to us.

      II.            In cases of abusive behavior or suspected violations of the Terms Of Service of the Website, we may share personal information, including IP address, with that service in order to investigate the violation and to take appropriate action.

    III.            To respond to court orders, or legal process, to prevent fraud or imminent harm, or to establish or exercise our legal rights or defend against legal claims

    IV.            If SEAZONA is acquired by or merged with another company, SEAZONA will transfer information about you to that other company.

      V.            YOU ARE SOLELY RESPONSIBLE for maintaining the confidentiality of your accounts and other sensitive information of your customers.  You are in control and solely responsible to whom you give access to your client accounts.  It is recommended to change passwords periodically.

    VI.            YOU ARE SOLELY RESPONSIBLE for ALL ACTIVITIES in your account AGREE to notify SEAZONA IMMEDIATELY if any unauthorized access and/or use of your accounts have been detected.

VII.         You will comply with all applicable local, state, national, and foreign laws, treaties, regulations and conventions in connection with your use of the website and Seazona services. Including without limitation those related to data privacy, and internal communications.

RESPONSIBILITIES:

YOU ARE SOLELY RESPONSIBLE to make sure emails and cell numbers are provided to Seazona where texts and emails will be sent to active and ORDER FROM CLIENTS is working property and you will be responsible to update any changes.

 YOU ARE SOLELY RESPONSIBLE to have a copy of your files. We do back up our data every day, however, we recommend exporting your data at least three times a year. You can export the data at any time and it can be done by day, by month, or by year.

Files and digital attachments are kept for 6 months free of charge. Files display the expiration date when attached. When those files/attachments are expired, we cannot restore them because they are permanently deleted. If you need to keep those files for a longer time, contact a Seazona representative to make the appropriate arrangements. Your other data is kept for 7 years.

YOU ARE SOLELY RESPONSIBLE to train your employees or anyone who uses the system that they know the importance of using safe internet. FURTHERMORE, it is your responsibility to ensure that YOUR CLIENTS privacy is protected.

You are solely responsible for applying and charging the right taxes to your customers and to comply with any government regulations. Tax rates can vary. You should confirm the tax rules within your jurisdiction and verify the tax rate is correct. You are completely responsible for any tax charged to your clients. You can disable the tax rate at any time by setting the Tax Rate field to zero or blank.

The Site is not intended for use by children under the age of 18. If you are under the age of 18 years old, you MUST have a parental or legal guardian set up your account and have them agree to the terms.

You are solely responsible for the late fees you collect. There may be limits on the amounts and types of fees you can charge your clients. You should confirm the fee rules within your jurisdiction and how they relate to you. You are completely responsible for any fees charged to your clients. You can disable the late fee at any time by setting the Late Fee field to zero or blank.

You are completely responsible for the billing and reconciliation, as well as validating the accuracy of the data. We highly recommend that you utilize the reports and export out your data to perform these activities.

LIMITATION OF LIABILITY

To the extent allowed by law, in no event shall the aggregate liability of Seazona exceed $1,000 US Dollars. In no event shall Seazona be liable to anyone for any indirect, punitive, incidental,  or consequential damages to your computer loss of data, content, images, revenue, profits, arising out of, or any way connected with this agreement included but not limited to the  accessing or use of, or inability to use. The limitation shall not apply in the event of your beach or related to your indemnity obligations.

THIRD PARTY PROVIDERS/PARTNERS
Third parties like shipEngine, Shippo, Credit Card vendors are separate businesses. You are solely responsible for looking/reading their prices, privacy policy , reviews contract, etc.. Using their services, you are assuming  all the risks related to the use and services and their policies. We may receive compensation for some of those integrations.

SOCIAL MEDIA FUTURES

Our Web site includes Social Media Features, such as Facebook, Twitter, and YouTube videos. These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Site.

Your interactions with these Features are governed by the privacy policy of the company providing it. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your personal information from our blog or community forum, contact us at [email protected] or call our office at 480-435-2747 in some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why. To delete personal information from a previous chat, you must go to the website which it originated from and request  your information be deleted from that site. With your consent we may post your testimonial along with your name. If you want your testimonial removed please contact us.

PROHIBITED ACTIVITIES

Using the websites provided or software in any manner that could damage, disable, overburden, disrupt or impair the Website or any SEAZONA server, or the network(s) connected to any SEAZONA server, or interfere with any other party‘s use of the Website or software.

You agree that you shall not remove, obscure, or alter any proprietary rights notices (including copyright) which may be affixed to or contained within the Service

Copyright Policy.  In addition to any other use restrictions set forth in this Agreement, you may not engage in or facilitate the distribution, reproduction of any copyrighted material or other proprietary information belonging to others without obtaining the prior written consent of Seazona.

INFORMATION SECURITY:

Seazona uses encryption and works very hard to protect Seazona customers. HOWEVER, Seazona  IS NOT RESPONSIBLE for ANY DAMAGE TO your computer, equipment, loss of data, content or other damages cost by a third party, miss use of the website, reckless use of the services, or using public internet connections

SERVICES DISRUPTIONS:

SEAZONA is software that is accessed via internet base, so if you do not have internet you will not be able to access your accounts.

SEAZONA also deployed new releases to update data or to add new futures that may put the system down for a short time. Most releases are done over the weekend to prevent disruption.

SEAZONA software is powered and sustained by servers that can have disruptions or can be down for a time. Seazona will do the best to restore services as soon as possible.

SEAZONA strives to keep the services up and running. However, ALL ONLINE SERVICES SUFFER occasional disruptions and outages, and SEAZONA is not liable for any disruption or loss you may suffer as a result. You should regularly backup the content that you store on our services by exporting data and saving hard copies. Having a regular backup plan and following it can help you prevent loss of your content.

GENERAL INFORMATION

Irrespective of which country you live in, you authorize us to transfer, store, and use your information in the United States, and any other country where we operate. In some of these countries, the privacy and data protection laws and rules regarding when government authorities may access data may vary from those in the country where you live.. If you do not agree to storage and use of your information in the United States, and any other country where we operate, please do not use the Sites or Services.

Data we have collected will be stored and processed outside the European Economic Area. We take all reasonable steps to ensure that personal data is kept secure at all times. Any service provider we use is under contractual obligation to ensure an adequate level of data protection in all processing of your personal data.

Under no circumstances will Seazona be responsible for any charges you incur as a result of erroneous charges, against your credit card, PAYPAL, UPS or other companies that result from a failure to see their terms and conditions. Tax laws and regulations change frequently. You are responsible to consult with competent professionals to assist you with any accounting or financial help needed to run your business; meet tax laws and regulations.

RECOMMENDATIONS

• TO USE safety measures and good practice to protect your data and the safety of the internet you are using to connect with.
• We recommend installing firewall programs to block hackers.
•  Use of anti-virus software to protect your computer or laptops
• You should set your system and browser at medium or higher to protect your information. This can be done under Tools or Options menu
• We recommend to use a  secure email for confidential information
• Do not leave the Seazona system open at all times. It is recommended to log off if you need to walk away from your laptop or computer.
• SECURE YOUR WIRELESS NETWORK
• The system is encrypted however hackers are constantly trying to find a hole on a browser, so we recommend securing your wireless network.
•  Avoid accessing public internet, it is not recommended TO SEND SENSITIVE PERSONAL INFORMATION OVER A PUBLIC wireless network
• Export data from Seazona frequently. Remember that this is a Web-based software so if you are unable to connect to the internet you will not be able to access your files.

PASSWORDS:

YOU will be given the first password when your account is set up; however you can change the password at any time. We recommend:

• Use strong passwords with 8 character and a mix or numbers and letters
• Change password regularly. This include employees that you give access to the websites provided by Seazona
• Keep your password secret

SAFE WAY TO SURF THE INTERNET

Only provide information on sites that start with https://

Do not open emails with suspicious links when you do not know the sender.

Don’t open suspicious emails, or warning boxes when you do not know the sender.

ACCEPTANCE:

The use of the Website and the services offered thereby is subject to your compliance with the Terms of Service, which constitutes a legal agreement between you and SEAZONA. EVERYTIME you use SEAZONA SOFTWARE, WEBSITE and the services offered thereby you SIGNIFY and ACKNOWLEDGE that you have read, understood and agree to be bound by the Terms of Service, which incorporates the privacy policy and any applicable posted guidelines. Use of the SEAZONA SOFTWARE and any services offered thereby signifies the acceptance of the Terms of Service.

If you do not agree with the terms do not provide SEAZONA with any information and do not submit payment information. Your continued use of the Website and the services offered thereby in light of changes to the Terms of Service, or to the relevant principles thereof will INDICATE your acceptance of the changes.
